This contribution starts with an overview of the historical circumstances that led to the establishment of the modern state. followed by an explanation of two initial phases in the development of the constitutional state. The public law nature of the state and the aims the state is entitled to pursue are explained in relation to the function of the state to regulate residence in modern complex societies in accordance with the public law calling of the state to bring about a just balance of interests. These issues are finally addressed within the context of South Africa's new constitutional dispensation.
